litigation culture is becoming endemic in Britain

of the claim and the resulting award often bear no relation to one another

is becoming the first expectation rather than the last

held in low esteem and appear to be encouraging a compensation culture
The fear of
litigation is raising costs and shutting down choices
UKpopdems will make sure that people receive reinstatement for genuine
loss, so we'll:
Re-define
loss to apply only where it is caused by direct human action
Promote self-insurance
to cover against passive loss in other cases
Regulate awards
so they cover immediate, tangible losses. Future losses only where proven
Make it possible
for most claims to be addressed by current small claims courts
Protect those
organising events from claims being made against them except where direct
action can be proved
What will this do for the British People?
You will
see the compensation culture gradually being halted and reversed
Millions of
pounds of individual, corporate and public money will be saved as the
fear of litigation reduces
You will be
protected from loss and damage by your own insurance
Where there
are disputed claims, many more will be adjudicated by small claims courts
without the involvement of lawyers
School, club
and charity events etc will go ahead without fear of litigation
Companion notes of the policy
Direct human
action applies where someone actually does something which causes immediate
loss, as in a driving accident, for example.
Passive loss
applies in situations where people are normally expected to exercise
care on their own behalf, as in tripping over pavements for example.
Children of
a very young age, to be agreed, must still be protected by the adults
assigned to look after them
Organisers
of approved activities for adults and older children, age to be agreed,
will be freed from responsibility
Loss awards
will be for immediate needs and restoration. Emotional losses will be
limited, and future losses will need proving annually, or at other times,
depending on the rule of the court.
